Maverick Fitness Holdings Privacy Policy

EFFECTIVE DATE: April 15, 2024

Maverick Fitness Holdings, LLC d/b/a Orangetheory® Fitness (“Maverick,” “we,” “us,” or “our”) values your privacy. This Privacy Policy (“Policy”) applies to the personal information that Maverick collects and explains our information practices and your related choices with regard to such information.

Privacy Policy

1. SCOPE

This Policy applies to the personal information we collect related to visitors to our website, www.orangetheory.com (the “Site”), users of our mobile applications (the “App” or “Apps”), visitors to Orangetheory Fitness studios (whether owned by Maverick or one of our franchisees), and the services available through our Site and App.

By visiting the Site, using or downloading the App, or using any of our services, you acknowledge that your personal information will be handled as described in this Policy. Your use of our Site, App, or services, and any dispute over privacy, is subject to this Policy and our Terms of Use, including its applicable limitations on damages and the resolution of disputes. The Terms of Use are incorporated by reference into this Policy.

If you are a California resident, please review Section 13 “Additional Information for California Residents” for important information about how we collect, use and disclose personal information about California residents and your rights under the California Consumer Privacy Act. Subject to applicable laws, US residents may have additional rights as set forth in Section 14.

If you are a non-US resident, you may locate country-specific privacy policies on the respective websites for each country by visiting our Global List of Orangetheory Locations.

This Policy does not apply to independently-owned and operated franchisees’ collection, use, and disclosure of your information, except as described in this policy with regard to data sharing and change of a franchisee.

This Policy also does not apply to the personal information that we collect about employees, contractors and other personnel related to their working relationship with us, or the personal information that we collect about applicants and candidates for a position with Maverick. In addition, we may collect, generate, use and disclose aggregate, anonymous, and other non-identifiable data related to our services, which is not personal information subject to this Privacy Policy.

2. THE INFORMATION WE COLLECT ABOUT YOU

We collect information about you directly from you and from other parties, as well as automatically through your use of our Site and App.

Information We Collect Directly From You. The information we collect from you depends on how you use our Site, App, and Services.

  • To Sign Up for a Trial Workout Online. To sign up for a trial workout at an Orangetheory® Fitness studio through our Site or App, you must provide us with your name, email address, phone number, date of birth, your payment information (in order to hold your trial workout reservation), and the studio you would like to attend for your workout. We also will collect information that you provide about any health conditions that could affect your ability to participate in a workout.

  • To Schedule or Purchase Sessions Online. To create an account to sign up for workout sessions or to purchase sessions online through our Site or our App, you must provide us with your name, physical address, email address, date of birth, phone number, height and weight, payment and billing information, and  username and password. If you complete a membership agreement or sign up for a fitness event, we also collect information that you provide about any health conditions that could affect your ability to participate in a workout. If you do not provide this information, you will not be able to create an online account, complete a membership agreement, or make a purchase.

    We will also collect information about the workouts you schedule and information about your purchases. You may also provide information about your preferences, such as your favorite studios and coaches.

  • When You Visit an Orangetheory Fitness Studio. If you sign up for a trial workout or become an Orangetheory member by registering at an Orangetheory® Fitness studio (whether owned by Maverick or one of our franchisees), you must provide us or our franchisee (as applicable) with your name, physical address, email address, date of birth, phone number, height and weight, marital status, emergency contact information, and payment and billing information. We or our franchisee (as applicable) also will collect information that you provide about any health conditions that could affect your ability to participate in a workout. If you do not provide this information, we or our franchisee (as applicable) may not be able to offer our services to you.

    We or our franchisee (as applicable) also will collect information about the workout sessions you schedule, details about your exercise frequency and goals (as provided by you), and information about your in-studio purchases. We or our franchisee (as applicable) will also collect information when you check in for a workout, such as your name, address, email address, member number, and studio location. If you provide your information to a studio owned by one of our franchisees, the franchisee will share the information you provide to us — please see the Information We Collect from Franchisees section below.

    As part of your workout session, you may choose to use our OTbeat heart rate monitors. If you do so, we will collect your workout session heart rate, and other workout statistics, such as the number of miles run or rowed.

    At certain locations you have the option of voluntarily participating in a body scanning program. This scan will measure your body’s muscle mass, fat percentage, and total body water, and will report your overall body composition and body mass index (based on your height, weight, gender, and age). These scans help you understand the effects of your workouts.

  • When You Express Interest in Purchasing an Orangetheory Franchise. If you express interest in owning an Orangetheory franchise, we will collect your name, physical address, email address, phone number, information about your finances, information about the location in which you are interested in starting your franchise, and any other information you provide to us with your submission.

  • Information We Collect from Franchisees. As described above, if you visit an Orangetheory Fitness studio owned by one of our franchisees, you will be providing your information directly to the franchisee. When you provide your information to a franchisee (including your in-studio sign up information, purchases you make at a franchise, and your workout information), the franchisee will make this information available to Maverick. The franchisee, however, handles all billing and account administration, including determining how your information is used for the franchisee’s own marketing purposes in accordance with applicable laws. If you register for a workout at a different location from your home studio, then the owners of both studios — the one at which you completed your workout and your home studio — will have access to information about your workout registration and participation. Information from your OTbeat heart rate monitor, however, is not shared among franchisees.

  • Information We Collect from Social Networking Sites. You may log into your online account or our Apps through Facebook. If you log in to your account or link your account to your Facebook profile, you must enter your Facebook email address and password. We will ask that you grant us permission to: (i) access your Facebook basic profile information (this includes your name, profile picture, gender, networks, user IDs, list of friends, date of birth, email address, and any other information you have set to public on your Facebook account); (ii) post to your wall; and (iii) access posts in your newsfeed. If you allow us to have access to this information, then we will have access to this information even if you have chosen not to make that information public through Facebook.

    We store the information we receive from Facebook with other information that we collect from you or receive about you in accordance with this Policy. Any social networking site, such as Facebook, controls the information it collects from you pursuant to its own terms. For information about how a social networking site may use and disclose the information it collects about you, including any information you make public through the social networking site, please consult the social network’s privacy policy. We have no control over how any social networking sites use or disclose the personal information they collect about you.

    We also collect information about you when you interact with us on social networking platforms. If you message us or tag us in a social network post, we will collect information about your message or the post we are tagged in.

  • Information We Collect Automatically. We automatically collect information about your use of our Site and Apps through cookies, web beacons, and other technologies, including technologies designed for mobile apps. To the extent permitted by applicable law, we combine this information with other information we collect about you, including your personal information. Please see the section “Cookies and Other Tracking Mechanisms” below for more information.

Site:

  • domain name;

  • your browser type and operating system;

  • web pages you view on the Site; links you click on the Site; your IP address;

  • the length of time you visit our Site and or use our Services; 

  • the referring URL, or the webpage that led you to our Site; and

  • your device’s location information, with your permission, to help identify Orangetheory Fitness studios located in your area and to help us market the Orangetheory® Fitness services.

App:

  • mobile device ID; device name and model; operating system type, name, and version;

  • language information;

  • activities within the App; and the length of time that you are logged into our App;

  • location information. With your permission, we will collect location information from your mobile device to: (1) track and map your out-of-studio run/walk workouts that you initiate in the App; (2) help you identify Orangetheory Fitness studios located in your area; and (3) to help us market the Orangetheory® Fitness services. You may turn off this feature through the location settings on your mobile device.

  • Out-of-Studio Workouts: You may use the App help you track your out-of-studio run/walk workouts. In addition to mapping your workout as described above, the we will collect the date and time of your workouts, the elevation of your workout, your speed and workout pace, your workout’s total distance, your step count and cadence, estimated calories burned, and, if you use a heart rate monitor during your workout, your heart rate data.

3. HOW WE USE YOUR INFORMATION

We use your information, including your personal information, for the following purposes:

  • To provide our services to you, to communicate with you about your use of our services, to respond to your inquiries, to fulfill your orders, and for other customer service purposes.

  • To tailor the content and information we may send or display to you, to offer location customization, to offer personalized help and instructions, and to otherwise personalize your experiences while using the Site and App. For example, we will display upcoming workouts at your preferred studios, or we may use your location information to show you Orangetheory Fitness studios in your area. We also use information collected through OTbeat, body scans, and your App out-of-studio workouts to customize workout programs and classes and to conduct workout challenges.

  • For marketing and promotional purposes in accordance with applicable laws. For example, we use your information, such as your email address, to send you news and newsletters, special offers and promotions, or to otherwise contact you about products, services, workout sessions, or other information we think may interest you.

  • We use your information (typically in the aggregate) to assist us in advertising the Orangetheory Fitness brand on unaffiliated websites and in evaluating the success of our advertising campaigns (including our online targeted advertising and offline promotional campaigns).

  • To better understand how users access and use our Site and Apps, both on an aggregated and individualized basis, in order to improve our Site and Apps and respond to user desires and preferences, and for other research and analytical purposes.

  • To administer our membership reward program.

  • To administer surveys and questionnaires, such as for market research or member satisfaction purposes.

  • To develop our franchise program. For example, if you inquire about operating an Orangetheory franchise, we will use your information to assess your suitability for owning one of our franchises.

  • To enable our franchisees to provide services to you in their independently owned and operated studios. In addition, if a franchisee leaves our franchise system, we will assist with facilitating the franchise’s transition to a new owner, including ensuring that the respective studio’s members’ personal information is transitioned to the new owner to ensure the members continue to receive services.

  • To comply with legal and regulatory obligations, as part of our general business operations, and for other business administration purposes, including authenticating your identity, maintaining customer records, to monitor your compliance with any of your agreements with us, to collect debts owed to us, to safeguard our business interests, and to manage or transfer our assets or liabilities, for example in the case of an acquisition, disposition or ‎‎merger, as described below.

  • Where we believe necessary to investigate, prevent or take action regarding illegal activities, suspected fraud or error, situations involving potential threats to the safety of any person, or violations of our Terms of Use or this Privacy Policy.

  • For other purposes we may inform you about from time to time.

4. HOW WE SHARE YOUR INFORMATION

We may share your information, including personal information, as follows:

  • Workout Sessions and Challenges. During a workout session, participants may share their name and OTbeat heart rate information with other session participants on our in-studio display screens. If you participate in a workout challenge, you may share your name and workout information with other challenge participants. You may also share information about your workouts and challenges you participate in with your social media accounts.

  • Orangetheory Franchisees. If we collect information from you requesting a trial workout in your area, we will provide that information to the local franchisee. When you sign up for a workout or schedule or purchase sessions through our Site or App or in-person at a studio, such information is hosted by Mindbody Inc. (“Mindbody”), a service provider under contract with Maverick and our franchisees. All data hosted by Mindbody is made available to Maverick and, if necessary, our franchisees in connection with the provision of our services. For example, if you complete a workout at a studio different from your home studio, then your data will be available to the owners of both studios. If a franchisee sells or otherwise transfers its franchise, we will transfer member information controlled by the outgoing franchisee to the successor franchisee. If you utilize a body scanner at a franchisee-owned studio, we will share your scan results with that franchisee.

  • Health-focused Apps and Websites. With your consent, we may share your personal information, including workout and health data, with unaffiliated health-focused mobile applications and websites to help you track your health and wellness information. If you choose to share your information with these apps, your personal information, including your health information, will be used in accordance with those apps’ and websites’ own privacy policies, not this one. Before consenting to sharing your personal information with any third party apps or websites, you should make sure that you have read, understood and agree to their own privacy policy and terms of use.

  • Affiliates. We may disclose the information we collect from you to our affiliates or subsidiaries; however, if we do so, their use and disclosure of your personally identifiable information will be subject to this Policy.

  • Service Providers. We disclose the information we collect from you to our vendors, service providers, contractors, and agents who perform functions on our behalf. In particular, the workout sign-up portal is hosted by Mindbody; as noted above, when you register for a workout, your information is available to the owner of that particular location and to Maverick.

We also disclose information in the following circumstances:

  • Business Transfers. If (i) we or our affiliates are or may be acquired by, merged with, or invested in by another company, or (ii) if any of our assets are or may be transferred to another company, whether as part of a bankruptcy or insolvency proceeding or otherwise, we may transfer the information we have collected from you to the other company. As part of the business transfer process, we will share certain of your personal information with lenders, auditors, and advisors, including attorneys and consultants.

  • In Response to Legal Process. We also may disclose the information we collect from you in order to comply with the law, a judicial proceeding, or other legal process, such as in response to a court order or a subpoena.

  • To Protect Us and Others. We also may disclose the information we collect from you where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Use or this Policy, or where it is reasonably necessary as evidence in litigation in which Maverick is involved.

  • Aggregate and De-Identified Information. We may share aggregate, de-identified, or anonymized information with third parties for marketing, advertising, research, or similar purposes.

No mobile information will be shared with third parties for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

5. OUR USE OF COOKIES AND OTHER TRACKING MECHANISMS

We and our service providers use cookies and other tracking mechanisms to track information about your use of our Site and App. We may combine this information with other personal information we collect from you (and our service providers may do so on our behalf).

Cookies. Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser for record-keeping purposes. Some cookies allow us to make it easier for you to navigate our Site and App, while others are used to enable a faster log-in process or to allow us to track your activities at our Site and App.

Cookie Settings. You can always change your preferences for cookies on our Site and opt-out of most third-party cookies(other than “essential” cookies that are necessary for our Site to function properly) through the “Cookie Preferences” button at the footer of our Site.

Clear GIFs, pixel tags and other technologies. Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your computer’s hard drive, clear GIFs are embedded invisibly on web or mobile application pages. We may use clear GIFs (aka web beacons, web bugs or pixel tags), in connection with our Site and App to, among other things, track the activities of Site visitors and App users, help us manage content, and compile statistics about usage of our Site and Apps. We and our service providers also use clear GIFs in HTML emails to our customers to help us track email response rates, identify when our emails are viewed, and track whether our emails are forwarded.

Analytics. We also use automated devices and applications, such as Google Analytics (more info here [https://support.google.com/analytics/answer/6004245?hl=en-GB]) to evaluate the use of our Sites and Services. We use these tools to gather non-personal data about users to help us improve our services and user experiences. These analytics providers may use cookies and other technologies to perform their services and may combine the information they collect about you on our Sites with other information they have collected for their own purposes. This Policy does not cover such uses of data by third parties.

Do Not Track. Currently, our systems do not recognize browser “do-not-track” requests. For more information about do-not-track signals, please click here [https://fpf.org/thank-you-for-visiting-allaboutdnt-com/]. You may, however, disable certain tracking as discussed above (eg., by disabling cookies).You also may further opt-out of targeted advertising by following the instructions in the Ad Networks section.

Global Privacy Control. Some browsers and browser extensions support the Global Privacy Control (“GPC”) that can send a signal to the websites you visit indicating your choice to opt-out from certain types of data processing, including data “sales” as defined under certain laws. In certain regions, when we detect such a signal, we will make reasonable efforts to respect your choices indicated by a GPC setting as required by applicable law.

Ad Networks. We use network advertisers to serve advertisements on unaffiliated websites or other media (e.g., social networking platforms). This enables us and network advertisers to target advertisements to you for products and services in which you might be interested. Ad network providers, advertisers, sponsors, and/or traffic measurement services may use cookies, JavaScript, web beacons (including clear GIFs), Flash LSOs, and other tracking technologies to measure the effectiveness of their ads and to personalize advertising content to you. These cookies and other technologies are governed by each entity’s specific privacy policy, not this one. We may provide these advertisers with information, including personal information, about you.

We may disclose certain information (such as your email address) to Facebook Custom Audiences (for more information on Facebook Custom Audience go here or to opt-out, go to the Facebook ad preferences page)—so that we can better target ads and content to you and others with similar interests on other websites or media (“Custom Audiences”). We may also work with other ad networks and marketing platforms that enable us and other participants to target ads to Custom Audiences submitted by us and others. You may also control how Facebook and other ad networks display certain ads to you, as explained further in their respective privacy policies or by using the opt-outs described below.

Users in the United States may opt out of many ad networks. For example, you may go to the Digital Advertising Alliance (“DAA”) Consumer Choice Page for information about opting out of interest-based advertising and their choices regarding having information used by DAA companies. You may also go to the Network Advertising Initiative (“NAI”) Consumer Opt-Out Page for information about opting out of interest-based advertising and their choices regarding having information used by NAI members.

Opting out from one or more companies listed on the DAA Consumer Choice Page or the NAI Consumer Opt-Out Page opt you out from those companies’ delivery of interest-based content or ads to you, but it does not mean you will no longer receive any advertising through our Site or on other websites. You may continue to receive advertisements, for example, based on the particular website that you are viewing (i.e., contextually based ads). Also, if your browsers are configured to reject cookies when you opt out on a consumer choice website, your opt out may not be effective.

6. LINKS

Our Site and Apps may contain links to unaffiliated entities’ websites. Any access to and use of such linked websites is not governed by this Policy, but instead is governed by the privacy policies of those websites. We are not responsible for the information practices of such websites.

7. SECURITY OF YOUR PERSONAL INFORMATION

We have implemented reasonable precautions to protect the information we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please be aware that despite our efforts, no data security measures can guarantee security.

You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

8. ACCESS TO YOUR PERSONAL INFORMATION

You may modify personal information that you have submitted by logging into your account and updating your profile information. You may also update your information by visiting your Orangetheory Fitness studio. Please note that copies of information that you have updated, modified, or deleted may remain viewable in cached and archived pages of the Site or App for a period of time.

Subject to applicable law, you may also have certain rights to access, review, update, and correct inaccuracies in your personal information in our custody and control. If you would like to submit a request to exercise your privacy rights under applicable laws, please submit your request through our Data Subject Request Portal or by contacting us at 888-413-1505 (toll free).  Please note that we may require additional information from you to verify your identity and process your request. We will respond to your request within the timeframes required by applicable law.  

You may also review and change your preferences for cookies on our Site and opt out of most cookies (other than those that are “strictly necessary”) through the cookie settings panel, which you can access by clicking  “Cookie Preferences” at the footer of our Site.

9. WHAT CHOICES DO I HAVE REGARDING PROMOTIONAL COMMUNICATIONS?

In accordance with applicable law, we will send periodic promotional communications to you. You may opt-out of such communications by following the opt-out instructions contained in the communication, or if you have opted-in to our promotional text messages, replying STOP. We will process opt-out requests in accordance with applicable law. If you opt-out of receiving promotional communications about recommendations or other information we think may interest you, we may still send you communications about your account or any services you have requested or received from us. App users may enable or disable push notifications by adjusting their App or device settings.

Our franchisees also send their own marketing communications in accordance with applicable law. If you no longer wish to receive marketing communications from our franchisees, you will need to separately opt-out of the respective franchisee’s marketing communications. We do not control, and are not responsible for, the promotional communications sent by our independently-owned and operated franchisees.

WE DO NOT SELL, RENT, LOAN, TRADE, LEASE, OR OTHERWISE TRANSFER FOR PROFIT ANY PHONE NUMBERS, OPT-IN DATA OR CONSENT COLLECTED TO ANY THIRD PARTY.

10. CHILDREN UNDER 13

Our Site, Apps, and services are not designed for children under the age of 13. If we discover that a child under the age of 13 has provided us with personal information, we will delete such information from our systems.

12. CHANGES TO THIS POLICY

This Policy is current as of the Effective Date set forth above. We may change this Policy from time to time, so please be sure to check back periodically. We will post any changes to this Policy on our Site and App. If we make any changes to this Policy that materially affect our practices with regard to the personal information we have previously collected from you, we will endeavor to provide you with notice in advance of such change by highlighting the change on our Site and App.

13. ADDITIONAL US DISCLOSURES

In addition to the rights described in section 8, residents of certain states (including Colorado, Connecticut, Utah and Virginia) may have additional rights under applicable privacy laws, subject to certain limitations, as set forth below.

Right to Non-Discrimination. Businesses may not discriminate against residents who exercise their rights under applicable privacy laws. Discrimination may exist where a business denies or provides a different level or quality of goods or services, or charges (or suggests that it will charge) different prices or rates or impose penalties on residents who exercise their privacy rights, unless doing so is reasonably related to the value provided to the business by the residents’ data.

Right to Opt-out. Residents of certain states have the right to opt-out of our “Sale” of their personal information, which may broadly include our selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating (collectively a “Sale”) residents’ personal information to another business or third party for monetary or other valuable consideration. Please note that while some of our sharing of personal information may be a “Sale” as defined by applicable law, we do not sell personal information for monetary compensation.  Subject to applicable law, residents may exercise their right to opt-out of the Sale of their personal information by visiting our Data Subject Request Portal or by contacting us at 888-413-1505 (toll free).

With over 10 years of experience in retail management, Leandrea has been deeply committed to fostering business growth and developing leadership skills. Known for her unwavering positive attitude and boundless energy, she consistently motivates others to strive for success in their endeavors. In 2019, she graduated from Texas Woman’s University with a Bachelor of Science in Fashion Merchandising Management, specializing in Marketing.

Dedicated to community service, Leandrea has collaborated closely with her sorority, Zeta Phi Beta, in support of the March of Dimes. During her leisure time, she indulges in her passion for listening to favorite books on Audible. An avid enthusiast of fashion and beauty, she also enjoys workouts at OTF and weightlifting sessions with her husband.

Whitney Gill

Regional Fitness Manager Dallas

Whitney is the Regional Fitness Manager over the Dallas Region. She initially began her OTF journey as a member in 2015 while pursuing her degree in Kinesiology at TCU. Her passion for fitness continued to grow when she began as an OTF coach at the Southwest Fort Worth studio; she now has taught over 4000 classes. Throughout her time with OTF, Whitney had held a variety of positions including Head Coach, Multi-Unit Head Coach, Training & Development Manager and most recently, Regional Fitness Manager. Outside of the studios, Whitney is an avid marathoner having qualified for the Boston Marathon six times, with aspirations of completing all seven of the world majors. She is also a certified run coach! When not in the studio Whitney loves spending every minute with her daughter Reese, husband Ryan and her two golden retrievers Colby & Bleu.

Whitney is passionate about fitness and loves seeing the benefits that OTF can provide to members looking to achieve their best version of themselves. She loves the supportive environment working at Maverick Fitness and is excited for continued growth with the company.

Liz Kolesar

Regional Fitness Manager Mid Cities

Liz comes to us from the Empire Portfolio Group out of New York. Liz has experience as a successful Studio Manager and Head Coach with a 700+ member studio. Since joining us at Maverick Liz has helped her studio in Dallas grow by about 70 members. Liz is development focused, brand knowledgeable, confident, and supportive. Members rave about Liz and her peers speak very highly of her since her arrival to Dallas.

Regional Sales & Operations Manager Mid Cities

Rachel has been an invaluable part of Maverick Fitness Holdings since August 2023, igniting growth and bringing More Life to the Mansfield studio. With nearly two decades of experience in sales and operations, coupled with her entrepreneurial background, Rachel brings a wealth of knowledge and passion to her role. An avid runner and committed to personal development, Rachel embodies a drive for excellence that will undoubtedly elevate our operations in the Mid Cities region.

Carlos Garcia

Regional Sales & Operations Manager Central

Since December 2020, Carlos has been instrumental in the growth and development of our McKinney studio. He elevated the McKinney location and team to new heights. His dedication embodies our core value of community. Starting as a Member Ambassador, Carlos quickly rose to Assistant Studio Manager and then Studio Manager. Now, he is leading operations for the Central region.

Amit Swaroop

Board Member

Amit Swaroop is a member of the Board of Directors for Maverick Fitness. He has a decade of M&A experience across investment banking and private equity investing. He is currently a Vice President with The Halifax Group, a private equity investment firm based in Washington, DC. Amit earned an MBA from the University of Chicago Booth School of Business, Beta Gamma Sigma and with Honors, and a BA in Mathematical Methods in Social Sciences and Economics from Northwestern University, where he also received an undergraduate certificate in Financial Economics from the Kellogg School of Management.

Ken Doyle

Board Member

Ken Doyle is a member of the Board of Directors for Maverick Fitness. He is currently a Senior Partner and serves on the Investment Committee of The Halifax Group, a private equity investment firm based in Washington, DC. Prior to joining Halifax in 2000, Ken was an Industry Leader and Vice President at GE Equity, the private equity subsidiary of GE Capital. Prior to GE Equity, he spent four years in investment banking as a Senior Associate for the Telecommunications Corporate Finance Group at Merrill Lynch and as an Associate with Chase Manhattan Bank in the Media and Telecommunications Group. Ken also spent three years with Ernst & Young in the Entrepreneurial Services Group and obtained a C.P.A. license in 1990. Ken graduated Magna Cum Laude with a B.S. from Boston College and received his M.B.A. from the Fuqua School of Business at Duke University. Ken is the Founder of Capital for Children (a non-profit investment partnership focused on at-risk children) and a member of WPO (World Presidents’ Organization). He is married with two adult children.

David Bard

Board Member

David Bard is a member of the Board of Directors for Maverick Fitness. He is the Managing Director and joined Halifax in 2018. He is responsible for assisting in sourcing, evaluation, execution and monitoring investments.Before joining Halifax, David was a Principal at American Securities, a New York based private equity firm, where he invested across sectors and served as a Director for several companies. Prior to that, David was with Bain Capital for nearly nine years and worked with the firm in several geographies. David began his career with McKinsey & Company. David currently holds an MBA from the Wharton School, where he was the Ford Fellow, and an MPhil in Economics with Development from the University of Cambridge, where he was a Gates Scholar. In addition, he completed the Jerome Fisher Program in Management & Technology at the University of Pennsylvania, earning a BS in Economics from The Wharton School and a BAS from Penn Engineering, where he graduated summa cum laude. David is currently a Senior Fellow at The Wharton School where he teaches, a Term Member at the Council on Foreign Relations, and works with Year Up, a nonprofit providing education and support for young adults seeking to achieve their potential after high school. David resides in Washington, DC with his wife and son.

Jaclyn Garcia

Marketing & Communications Director

When Jaclyn took the position at Maverick Fitness, she knew it was going to be the perfect fit. Her energetic personality and marketing background prepared her for the work she does creating and coordinating promotions, partnerships with local non-profits such as Texas Special Olympics and American Heart Association, overseeing social media and communications. She enjoys the people she works with and their goal to better other’s lives by providing the best fitness product out there.

Jaclyn’s first job was at Six Flags Over Texas as a 15-year-old where she enjoyed meeting celebrities such as Flo Rida, Katy Perry and more. She worked at Six Flags through college and was able to secure a marketing supervisor position there after graduating. She continued in the entertainment business while working at LEGOLAND Discovery Center and SEALIFE Grapevine. Jaclyn then landed at The Barber Shop Marketing where she did experiential events for clients such as General Motors, Chevron, Ford, AT&T and lead the promotions department. She was involved in the rollout for the new Chevy Colorado and helped to execute several vehicle trainings for Buick, GMC and Chevrolet. In between two tenures at The Barber Shop, Jaclyn worked with Zimmerman Advertising where she handled the Nissan Account.

Jaclyn is married to Javier and has two young boys, Christian and Cruz. They lead an active lifestyle going to parks, the Dallas Zoo, feeding the ducks, the boys even love going to Target. She doesn’t have time for hobbies but does make time to work out at least four times a week and get her daily steps in on her fitbit while binge watching her favorite shows.

Dylan Pierpont

Area Sales & Operations Director

Dylan Pierpont is an accomplished professional with over 7 years of dedicated service to Maverick Fitness Holdings. Starting out as a Sales Associate, Dylan quickly rose through the ranks, demonstrating exceptional leadership and management skills. Currently serving as the Area Sales & Operations Director, she oversees the successful functioning of studios across the North Texas region.

Throughout her tenure, Dylan has played a pivotal role in the growth and expansion of Maverick Fitness Holdings. As a Studio Manager, she led and managed various studios, consistently achieving outstanding results. Her expertise in operations management, combined with her exceptional sales acumen, led to the successful
opening of new studios under her supervision.

With a track record of managing and leading a portfolio of up to 10 studios, Dylan has proven her ability to drive revenue growth and optimize operational efficiency. She is known for her strong leadership, strategic vision, and a relentless dedication to developing her team and driving their success.

Beyond her professional achievements, Dylan is a devoted mother of three, a loving wife, and a passionate runner having completed a marathon at age 17. She actively engages in the Orangetheory Fitness community and draws inspiration from her own fitness journey. Her personal dedication to health and wellness is reflected in her drive to create exceptional fitness experiences for her team and members.

Dylan’s unwavering commitment to excellence, combined with her passion for team growth and studio development, has made her a valuable asset to Maverick Fitness Holdings. She continues to set new benchmarks in the fitness industry, driving success and achieving remarkable results.

Hollye Nelson

Regional Training & Development Specialist
As a Regional Training and Development Specialist for Sales & Operations at Maverick Fitness, Hollye has had the privilege of being part of this amazing company for over 6 years, with 10+ years in the fitness industry. Starting as a Studio Manager, she had the opportunity to grow and evolve within the organization, which has been incredibly rewarding.
What truly drives Hollye is her passion for helping teams learn and grow in their roles. She finds immense joy in empowering individuals to reach their full potential and watching them flourish. Seeing their progress and witnessing the positive impact they make in their work is truly gratifying.
Outside of her professional life, she is dedicated to her family. Her husband, Ben, and their two children, Macie and Pierce, are the center of her world. They are a sports-loving family, and you can often find them cheering on one of their sports teams over the weekend!
In her free time, she also has a great love for travel. Exploring new places and immersing herself in different cultures is something that fuels her curiosity and sense of adventure. Whether it’s a relaxing beach vacation or an exciting city escapade, she finds inspiration and rejuvenation through those experiences.
Overall, she considers herself fortunate to have found a fulfilling career at Maverick Fitness and to have a loving family and team that supports and motivates her. Hollye is constantly seeking new ways to make a positive impact and looks forward to what the future holds here at Maverick Fitness.

Stacie Morgenstern

Regional Fitness Training & Development Team
Stacie Morgenstern is a member of the Regional Fitness Training and Development team. She has been with Orangetheory Fitness for just over 8 years, 6 ½ years with Maverick Fitness. Throughout her time with Maverick, she opened the North Plano studio as a coach. She became Head Coach soon after opening and helped grow that studio for about 2 ½ years. She received the opportunity to move up to the Regional Team as an Assistant Regional Fitness Manager where she stepped out of the studio and saw the business as a whole. In October 2021, she became the Regional Fitness Manager overseeing the Mid-Cities region, where she managed 7 studio locations. At the end of 2022, she joined the Training and Development team where she now facilitates OTFit, workshops, and conducts coaching classes all over the region. She helps with development and works with the rest of the regional team to deliver the best possible experience for her members.
She loves working for Maverick Fitness. She’s been a fitness fanatic for most of her life, and she religiously takes OTF workouts 5-6 times a week – she can’t start her day without her OTF workout!
Her goal is to continue to grow and learn everything she can in her role, to help her coaches continue to grow and excel and help her members continue to get better and learn to love fitness as much as she does!

Meghan Clark

Regional Training & Development Specialist
Meghan has been with Orangetheory Fitness for the past six years. As a Regional Training and Development Specialist, she plays a key role in shaping training programs, creating learning content, and developing coaches.
Her passion for fitness began early on, leading her to pursue a degree in Exercise Science from the University of Arkansas. After graduating, Meghan started her career by training athletes and worked as a Rehabilitation Specialist. It was immensely fulfilling to help individuals reach their peak performance and guide them through their recovery journeys.
During her time in college, Meghan had the amazing opportunity to dive for the University of Arkansas for four years. Representing her university and being part of a team was an incredible experience, and it taught her discipline, perseverance, and teamwork.
Outside of work, her favorite thing to do is spend time with her husband, Ben, and their adorable dogs, Pepper and Gambit. They love nothing more than hanging out together, watching razorback sports and cheering on their favorite team. Go Hogs!

Maddy Dahl Allen

Regional Training & Development Specialists
Maddy Dahl Allen is one of our Regional Training & Development Specialists for Sales & Operations. She graduated from Texas A&M University with her Bachelor's degree in Business Management Pre-Law. During her time in College Station, she found her true passion within the world of fitness. Over the past six years, she immersed herself in the fitness industry. It has been a journey of both growth and joy. She joined the Maverick Fitness Holdings family in March of 2021 and has loved every moment since.
After her time in the Regional Sales & Operations role, Maddy transitioned to the Regional Training & Development team in November of 2022. She would say that this role allows her to do what she loves most: working with studio teams to unlock their full potential. She finds that the most rewarding part of her role is seeing individuals grow, flourish, and become the best versions of themselves. Within her role, Maddy is also able to interact directly with our members – serving them with outstanding customer service and fostering a tight-knit community remains at the top of her priority list.
In her free time, she loves to travel with her husband, Brady, and 2 dogs, Millie & Theo. Maddy has been to 9 countries and 42 states. Her love of travelling broadens her horizons and fuels her curiosity.

Amy Iltis

Regional Fitness Manager Fort Worth

Amy is our Regional Fitness Manager for the Fort Worth region. She spent
most of her long career in the fitness industry providing one-to-one personal
training and nutrition coaching. After a long career in the fitness industry,
we’re so happy to have Amy in the Maverick Fitness Holdings family. She
worked her way up to her position as a Regional Fitness Manager starting as
a Coach. She is proud of her part in encouraging the development of other
members of our team through mentorship and coaching. She is an innovator
and solutions-oriented and she is excited to see Maverick grow and evolve.

Outside of work, Amy loves Mexican food, pasta, and a good Margarita!

Amy enjoys working with Maverick and learning to lead, manage and support
our teams by pushing herself beyond what she thought she could do. She
loves the supportive and encouraging environment at Maverick and she is
excited to see what else she can achieve.

Penny Tracy

Area Fitness Director

Penny is the Area Fitness Director for Maverick Fitness Holdings. Prior to joining the OTF team, Penny owned her own fitness consulting company. She has also worked in the medical industry as an independent medical examiner. Her goal is to grow with Maverick as we expand and work hard to get her Master Trainer Certification. Penny is proud of her achievements here at Maverick, including guiding and promoting Head Coaches to the Regional Fitness and Training team and holding staff retention at a higher percentage than average. She is most proud of her Orangetheory journey from member all the way up to Area Fitness Director. With a love for Mediterranean food, Penny likes to travel. Her favorite workouts include strength training.

Penny enjoys Maverick’s professional approach to the fitness industry, with a
focus on continued development, growth opportunities and team
camaraderie.

Kimberly Aguilar

Regional Fitness Manager Central
Kimberly holds a NSCA-CPT certification along with a Bachelor of Exercise Science degree. She has over 20 years of experience in the fitness industry and couldn’t be happier that her passion for health and wellness led her to Orangetheory Fitness. She is proud to be the Regional Fitness Manager for Maverick Fitness Holdings, Central Region. Previously, Kimberly spent 10 years as an Area Operations Manager for LA Fitness and was a Personal Trainer for competitive figure skaters.
Kimberly grew up in the Detroit area and has a love for all things Michigan, especially northern Michigan. It wasn’t until 6 years ago that Texas became home. Growing up, she dedicated 15 years to her figure skating career and still maintains a love for the sport. When not under the orange lights, you can find Kimberley spending time with her family, enjoying travel, and paddle boarding.
The community, positive atmosphere, and workout design are what Kimberly loves most about OTF. Excited for the future, Kimberly looks forward to growing in her role, future challenges, and to help make the Maverick and Orangetheory Fitness family the strongest there is.

Jacob Ormsby

Regional Sales & Operations Manager Fort Worth
Jacob has 20+ years of experience in the sports, outdoors, and fitness industries and he has held numerous leadership roles in single and multi-unit capacities. He is driven to helping others realize their personal and professional goals, inside and outside the workplace.
Jacob is an avid runner, who enjoys training for various road and trail distance events. When not training for his next race, Jacob loves coaching his son’s sports teams, and spending time with his family.
Jacob enjoys working with such a dynamic and diverse team at Maverick / OTF, as well as impacting our members’ lives through fitness.

Sean Henderson

Regional Sales & Operations Manager Dallas
Sean Henderson is the Regional Sales and Operations Manager for the Dallas region. He joined the Maverick Team in October 2022 and is a dynamic leader who embodies professionalism and sets high standards in every endeavor. With over 18 years of experience in leadership roles, Sean excelled as a Director of Operations in the restaurant industry. Known for his ability to lead by example, he inspires his team to achieve excellence while maintaining a compassionate approach to leadership. Sean's dedication to training and developing individuals is instrumental in shaping successful teams, and he is an invaluable asset to our organization.
Outside of work, Sean loves spending quality time with his three amazing kids and his wife, Monica. Not only does he like to remain active by hitting the gym or taking classes, but he also coaches his kids’ track teams. Sean consistently prioritizes nurturing relationships and building strong connections both at home and in his community.
With his wealth of experience in operations and his passion to empower those around him to reach their full potential, Sean’s goal is to elevate the success of the Dallas Region.

Bryan Wallace

Chief Financial Officer

Bryan is a Certified Public Accountant who is adept at leveraging his experience in accounting and finance to help companies meet the challenges of today’s environment. Bryan has worked for more than 20 years at both public and private companies and believes the solutions that solve problems, improve processes, and increase service levels are key to being an engaged partner.

Bryan is a native to Utah and has been living in Frisco for the past 14 years where he enjoys spending time with his wife, Evonne, and watching their kids, Kelsie, Jackson and Chloe, play soccer, volleyball, and dance. Bryan holds a Master of Business Administration from Utah State University and a Bachelor of Science in Accounting from Utah Valley University. Bryan works out at Orangetheory three to four times a week and buys, sells, and maintains cars in his free time.

Bryan has been surrounded by some of the most talented people in retail while working for JCPenney, Forty-Five Ten, Texas Family Fitness, and Maverick Fitness. His favorite thing about Maverick Fitness is the people that he works with.

Michael Piermarini

Chief Product Officer, Maverick Fitness, LLC

Currently, as Chief Product Officer at Maverick Fitness, Michael oversees fitness operations within the DFW region of the fastest growing franchise brand (2018) in the United States. He is responsible for spearheading strategic shifts and is focused on executing long-term, workable business initiatives designed to drive performance excellence, increase sales revenue while reducing costs, and streamline operations. 

Previously, as the Director of Fitness for Orangetheory Fitness, Michael rose through the ranks to ultimately lead and manage all aspects of the global fitness department including long-term business strategy development, recruiting, hiring, and retention of worldwide leadership teams, customer relationship management, and oversight of multi-platform product training curriculum and content. During this time, he identified opportunities and provided leadership on the creation and delivery of two proprietary, solution-focused software applications (patents pending), negotiated numerous world-recognized partnerships, and strengthened Orangetheory Fitness’ position as a globally recognized, fitness industry disrupting brand. He has previously shared his international business expertise through numerous global speaking events and has been published in outlets around the world including Fast Company, Today.com, Shape, Men’s Journal, Livestrong, and Runners World.

Before joining Orangetheory Fitness, Michael coached world-class athletes and business executives using customized mental and physical solutions designed to increase personal and professional performance through his own company aptly named ‘Performance is Personal.’ As former member of Team USA/USA Triathlon, Michael draws on his experience as one of the world’s top multi-sport athletes to passionately lead and develop others to perform at their best. 

Michael holds a bachelor’s degree in psychology from St. Edward’s University, Magna Cum Laude, and a master’s degree in psychology, with honors, from Southern Methodist University. He has served on several advisory panels responsible for setting worldwide health and wellness standards through research and education, including The Cooper Institute (CI) and the National Council on Strength and Fitness (NCSF).

Shane Adams

CEO, Maverick Fitness Holdings, LLC

As CEO of Maverick Fitness Holdings, LLC, a private equity/management firm based in Frisco, TX, Shane was asked in 2013 to partner with Orangetheory Fitness as acting Area Developer for the North Texas region. Adams and his team are responsible for 33 locations in the Dallas-Fort Worth area.

Before devoting his work fulltime to Maverick Fitness Holdings, Adams was director of operations for both commercial and residential construction companies in the Dallas area. His time spent managing large, fast-paced organizations prepared him to pursue his passion of helping others. His enthusiasm for fitness and impacting lives for the better has become his focus while continuing to grow Maverick Fitness Holdings.

In his free time, Adams loves to be with family! He and his wife Amy have two super awesome kids, Kayla and Chase. If you can’t find Shane in the office or at the gym, he is probably at one of the local athletic fields coaching one of his kids many teams!
